Terms of Service

These Terms of Service form a binding agreement between you and Bestia Technologies Inc. By using superpwr, you agree to these terms.

superpwr is an AI-powered app manufacturing platform that helps users turn conversations, instructions, and domain expertise into working software, deployments, and supporting assets.

You may not use the service for illegal activity, fraud, abuse, or to violate the rights of others. You are responsible for the prompts, files, and other input content you submit, and you represent that you have the rights needed to use that content.

superpwr includes AI-powered voice communication features that enable automated outbound and inbound phone calls on behalf of platform users. These features use artificial intelligence to conduct conversations, and calls are placed through third-party telecommunications providers.

By using voice features, you acknowledge and agree that:

• You are solely responsible for obtaining all required consent from call recipients before placing calls, including prior express written consent for telemarketing calls as required by the Telephone Consumer Protection Act (TCPA) and applicable state laws.
• You will comply with all applicable federal, state, and local laws governing automated and AI-assisted telephone calls, including but not limited to the TCPA (47 U.S.C. § 227), the Telemarketing Sales Rule (TSR), and state telemarketing statutes.
• You will not place calls to any number listed on the National Do Not Call Registry (donotcall.gov) or any applicable state do-not-call list, unless an exemption applies and you have documented the basis for that exemption.
• You will only place calls between the hours of 8:00 AM and 9:00 PM in the called party's local time zone, or within stricter windows required by applicable state law.
• You will clearly identify yourself or your organization and disclose that the call is being conducted by an AI system at the beginning of each call, as required by FCC regulations effective February 2024.
• You will honor all opt-out requests immediately and maintain accurate records of consent and opt-out requests for at least five years.
• You will not use the platform to spoof caller ID information, place harassing or abusive calls, or engage in any form of illegal robocalling.
• Calls may be recorded for quality assurance, training, and compliance purposes. You are responsible for complying with all applicable call recording consent laws, including one-party and two-party consent requirements that vary by state and jurisdiction.

You may not use superpwr to:

• Place automated calls or send messages without required consent from recipients.
• Transmit misleading or inaccurate caller ID information.
• Contact numbers listed on federal or state do-not-call registries without a valid exemption.
• Place calls outside permitted hours (8:00 AM - 9:00 PM local time of the recipient).
• Engage in war-dialing, predictive dialing to random numbers, or high-volume calling with unreasonable unanswered call rates.
• Harass, threaten, defraud, or intimidate any person.
• Generate malware, malicious code, or software designed to cause harm.
• Impersonate another person, entity, or organization.
• Circumvent platform security controls or access restrictions.
• Resell or redistribute platform access without written authorization.
• Violate any telecommunications regulation or the terms of our infrastructure providers.
• Use the platform for any purpose that is unlawful or prohibited by these terms.

Violation of these rules may result in immediate suspension or termination of your account without notice or refund.

You agree to indemnify, defend, and hold harmless Bestia Technologies Inc., its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the platform, including but not limited to claims related to TCPA violations, unauthorized calling, data privacy breaches, intellectual property infringement, or breach of these terms.

You retain ownership of your input content and, as between you and superpwr, you own the generated apps and outputs created for your account. Bestia Technologies Inc. retains ownership of the superpwr platform, infrastructure, software, branding, and all underlying platform intellectual property.

Certain features may require prepaid credits. Credits are used for AI compute time, agent work, deployments, and related platform operations. Credits are non-refundable and expire 12 months after purchase unless otherwise required by law.

superpwr uses AI systems to generate plans, code, and other outputs. AI-generated outputs can be incomplete, incorrect, or unsuitable for your use case. You are responsible for reviewing, testing, and approving outputs before relying on them.

You may stop using the service at any time. We may suspend or terminate access if you violate these terms, create risk for the platform, or if we discontinue the service. On request, we will make a reasonable effort to provide an export of your account data before deletion where technically feasible.

To the fullest extent permitted by law, the service is provided on an as-is and as-available basis. Bestia Technologies Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities arising from your use of superpwr.

These terms are governed by the laws of the State of California, USA, without regard to conflict of law rules.
